1. Acceptance of Terms
By accessing or using Scrutexity (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Scrutexity provides claim intelligence infrastructure for regulated marketing environments. The Service analyzes publicly accessible websites, AI-generated answer surfaces, and advertising content to produce structured observations of unsupported claims, evidence gaps, proof status, and pattern-similarity signals relative to known enforcement patterns. Outputs take the form of claim review records, proof-gap mappings, risk-signal indicators, and timestamped observation receipts.
The Service does not render legal, clinical, medical, regulatory, or advertising compliance opinions. All outputs are provided for informational and risk-awareness purposes only and do not constitute professional advice of any kind.
3. Public-Source Observation Only
The Service observes and records content that is already publicly accessible. You may submit any publicly available URL for observation. By submitting a URL, you represent and warrant that you have a lawful basis to access and analyze the content at that URL. The Service does not access password-protected pages, internal systems, or non-public data.
4. Observation Records
Each observation may generate a shareable, timestamped record containing the observed domain, extracted claims, evidence-status assessments, risk-signal indicators, and pattern-similarity scores. By using the Service, you acknowledge that:
- Observation records may be accessible to anyone with the unique record URL.
- Records are dated, version-tracked, and may be hash-chained for integrity verification as part of the Claim Record Transparency protocol.
- You may request that a specific record be made unlisted or removed via the Correction Request process below.
- Scrutexity reserves the right to publish anonymized, aggregated data derived from observations for research, benchmarking, and methodological transparency purposes.
5. Correction Requests & Disputes
Operators of observed domains who believe an observation record contains factual errors, misrepresentations, or stale content may submit a correction or removal request:
- Use the “Request Correction” link available on every public observation record, or
- Email disputes@scrutexity.com with the record URL and the specific findings you wish to dispute.
Scrutexity will review the request within 14 business days and may, at its discretion, update the record, append a counter-statement, or remove the public listing. Repeated or bad-faith dispute submissions may result in suspension of the submission privilege.
6. User Accounts
To access paid features (Pro Monitoring, Bureau documentation, Enterprise API), you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
7. Payment and Subscriptions
Paid plans are billed through Stripe. Subscription fees are non-refundable except as required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Downgrades apply at the next billing cycle.
8. Acceptable Use
You agree not to:
- Use the Service to harass, defame, or illegally target any individual or entity.
- Attempt to circumvent rate limits, access controls, or subscription gating.
- Scrape, extract, or reverse-engineer the Service’s outputs for the purpose of building a competing claim-intelligence or proof-mapping product.
- Submit URLs or content that violate any applicable law or third-party right.
9. Intellectual Property
The Service’s software, algorithms, methodology, prompt designs, hash-chain infrastructure, and generated observation frameworks are proprietary to Scrutexity. You retain ownership of any content you submit for observation. Scrutexity retains ownership of the observation records, aggregated data, derived signals, and methodological improvements produced by the Service.
10. Disclaimers and Limitation of Liability
The Service is provided “as is” without any warranty, express or implied. Scrutexity does not guarantee the accuracy, completeness, timeliness, or reliability of any observation record, proof-gap assessment, risk signal, or pattern-similarity score. Observations are based solely on visible public content at the time of capture and may not reflect the current state of the observed domain.
Scrutexity is not a law firm, medical practice, regulatory consultancy, or compliance advisory. No output from the Service constitutes legal, clinical, medical, regulatory, advertising, or compliance advice. You are solely responsible for ensuring that your use of observation records and any actions taken in response to them comply with all applicable laws, regulations, and professional standards.
To the fullest extent permitted by law, Scrutexity, its affiliates, and its licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any decision or action taken in reliance on an observation record; or (iii) any unauthorized access to or alteration of your transmissions or data.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York.
12. Changes to Terms
We may modify these Terms at any time. Material changes will be notified via email or a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
